You have the right to receive information about the origin, recipient, and purpose of your stored personal data at any time free of charge. You also have the right to request the correction or deletion of this data. If you have consented to data processing, you can withdraw this consent at any time for future processing. You may also have the right to request that the processing of your personal data be restricted under certain circumstances. Additionally, you have the right to lodge a complaint with the relevant supervisory authority.

3. General Information and Mandatory Disclosures

Data Protection

I take the protection of your personal data very seriously. I handle your personal data confidentially and according to legal data protection regulations and this privacy policy.

When you use this website, various personal data is collected. This privacy policy explains which data I collect and what I use it for. It also explains how and why this happens.

Please note that data transmission over the internet (e.g., email communication) may have security vulnerabilities. Complete protection of data from third-party access is not possible.

Information on the Responsible Entity

The data controller for this website is:

Fabian Schmidt
Hobrechtsfelder Chaussee 174b
13125 Berlin
Phone: +49 (0) 162 43 07 496
Email: office@fabianschmidtmusic.com

The data controller is the person or legal entity who, alone or jointly with others, determines the purposes and means of processing personal data (e.g., names, email addresses, etc.).

Withdrawal of Your Consent to Data Processing

Many data processing operations are only possible with your explicit consent. You may withdraw your consent at any time by sending an informal email to me. The lawfulness of data processing up to the withdrawal remains unaffected.

Right to Object to Data Collection in Specific Cases and to Direct Marketing (Article 21 GDPR)

If data processing is based on Article 6 paragraph 1 (e) or (f) of the GDPR, you have the right to object at any time to the processing of your personal data for reasons arising from your particular situation; this also applies to profiling based on these provisions. The relevant legal basis on which processing is based can be found in this privacy policy. If you object, I will no longer process your affected personal data unless I can demonstrate compelling legitimate grounds for the processing which override your interests, rights, and freedoms or the processing serves to establish, exercise, or defend legal claims (objection under Article 21 paragraph 1 GDPR).

If your personal data is processed for direct marketing purposes, you have the right to object at any time to the processing of your personal data for the purposes of such advertising; this also applies to profiling insofar as it is related to such direct marketing. If you object, your personal data will no longer be used for direct marketing purposes (objection under Article 21 paragraph 2 GDPR).

Right to Lodge a Complaint with the Competent Supervisory Authority

In the event of breaches of the GDPR, affected individuals have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, place of work, or the location of the alleged infringement. The right to lodge a complaint is without prejudice to any other administrative or judicial remedies.

Right to Data Portability

You have the right to have data which we process automatically based on your consent or in fulfilment of a contract handed over to you or a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done to the extent technically feasible.

SSL or TLS Encryption

This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or enquiries you send to us as the site operator. You can recognise an encrypted connection by the browser’s address bar changing from “http://” to “https://” and by the lock icon in your browser line.

If SSL or TLS encryption is activated, data you transmit to me cannot be read by third parties.

Right to Information, Deletion, and Correction

Within the framework of applicable legal provisions, you have the right to free information at any time about your stored personal data, its origin, recipients, and the purpose of data processing, as well as, where appropriate, the right to correct or delete this data. For this purpose and for other questions on the subject of personal data, you can contact me at any time via the address provided in the legal notice.

Encrypted Payment Transactions on this Website

If there is an obligation to transmit your payment data (e.g., account number for direct debit) after the conclusion of a paid contract, this data will be required for payment processing.

Payment transactions using common payment methods (Visa/MasterCard, direct debit) are processed exclusively via an encrypted SSL or TLS connection. An encrypted connection can be recognised by the browser’s address bar changing from “http://” to “https://” and by the lock icon in your browser line.

With encrypted communication, your payment data, which you transmit to me, cannot be read by third parties.

Right to Restrict Processing

You have the right to request the restriction of the processing of your personal data. You can contact me at any time using the address provided in the legal notice. The right to restrict processing exists in the following cases:

  • If you dispute the accuracy of your personal data stored by me, I usually need time to verify this. For the duration of the verification, you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data is unlawful, you may request the restriction of data processing instead of deletion.
  • If I no longer need your personal data, but you require it to exercise, defend, or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of deletion.
  • If you have filed an objection under Article 21 paragraph 1 GDPR, a balance must be struck between your interests and mine. As long as it is not clear whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data – apart from storage – may only be processed with your consent or for the establishment, exercise, or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or a Member State.

4. Data Collection on this Website

Cookies

This website uses “cookies.” Cookies are small text files that do not harm your device. They are stored either temporarily for the duration of a session (session cookies) or permanently (persistent cookies) on your device. Session cookies are automatically deleted after your visit. Persistent cookies remain on your device until you delete them or they are automatically deleted by your web browser.

Third-party cookies may also be stored on your device when you enter my website. These enable specific third-party services (e.g., payment processing cookies).

Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them (e.g., the shopping cart feature or video display). Other cookies serve to analyse user behaviour or display advertising.

Cookies required to carry out the electronic communication process (necessary cookies), provide specific functions you desire (functional cookies, e.g., shopping cart functionality), or optimise the website (e.g., cookies to measure web audiences) are stored based on Article 6 paragraph 1 lit. f of the GDPR unless otherwise stated. I have a legitimate interest in storing cookies to ensure the technically fault-free and optimised provision of my services. If consent for cookies is requested, the storage of relevant cookies is based solely on this consent (Article 6 paragraph 1 lit. a GDPR), which may be withdrawn at any time.

You can set your browser to inform you about the placement of cookies and allow cookies only in individual cases, exclude the acceptance of cookies for certain cases or generally, and enable automatic deletion of cookies when the browser is closed. Deactivating cookies may limit the functionality of this website.

If third-party cookies or cookies for analysis purposes are used, I will inform you separately within this privacy policy and request consent if necessary.

Contact Form

If you submit an enquiry via the contact form, your details from the form, including any contact information you provide, will be stored to process your request and any follow-up questions. I will not share this data without your consent.

The processing of this data is based on Article 6 paragraph 1 lit. b GDPR if your request relates to the fulfilment of a contract or is necessary to carry out pre-contractual measures. In all other cases, processing is based on my legitimate interest in the effective handling of the requests directed at me (Article 6 paragraph 1 lit. f GDPR) or on your consent (Article 6 paragraph 1 lit. a GDPR) if requested.

The data you enter in the contact form will remain with me until you request deletion, withdraw your consent to storage, or the purpose for data storage no longer applies (e.g., after your enquiry has been completed). Mandatory legal provisions – particularly retention periods – remain unaffected.

Enquiries by Email or Telephone

If you contact me by email or telephone, your request, including all resulting personal data (name, request) will be stored and processed by me for the purpose of handling your enquiry. I do not share this data without your consent.

The processing of this data is based on Article 6 paragraph 1 lit. b GDPR if your enquiry is related to the fulfilment of a contract or necessary for pre-contractual measures. In all other cases, processing is based on my legitimate interest in effectively processing the requests made to me (Article 6 paragraph 1 lit. f GDPR) or on your consent (Article 6 paragraph 1 lit. a GDPR) if requested.

The data sent to me via contact enquiries will remain with me until you request deletion, withdraw your consent to storage, or the purpose for data storage no longer applies (e.g., after your enquiry has been handled). Mandatory legal provisions – especially statutory retention periods – remain unaffected.

Registration on this Website

You can register on this website to access additional features on the site. The data entered will only be used for the purpose of using the respective offer or service for which you have registered. Mandatory information requested during registration must be provided in full; otherwise, I will reject the registration.

In the event of significant changes such as changes to the scope of the offer or necessary technical changes, I will use the email address provided during registration to inform you.

The processing of data entered during registration is for the purpose of executing the user relationship established through registration and, where applicable, to initiate further contracts (Article 6 paragraph 1 lit. b GDPR).

The data collected during registration will be stored by me for as long as you are registered on this website and then deleted. Statutory retention periods remain unaffected.

Comment Function on this Website

In addition to your comment, information about when the comment was created, your email address, and, if not posted anonymously, the username you chose will be stored.

Storage of the IP Address

My comment function stores the IP addresses of users who post comments. Since I do not check comments on this website before they are published, I need this data to take action against the author in cases of legal violations such as insults or propaganda.

Subscribing to Comments

As a user, you can subscribe to comments after registering. You will receive a confirmation email to check whether you are the owner of the provided email address. You can unsubscribe from this function at any time via a link in the info emails. Data entered when subscribing to comments will be deleted in this case; if you have sent this data to me for other purposes and in other locations (e.g., newsletter subscription), this data will remain with me.

Comment Storage Duration

Comments and related data are stored and remain on this website until the content commented on is completely deleted or the comments are removed for legal reasons (e.g., offensive comments).

Legal Basis

Comments are stored based on your consent (Article 6 paragraph 1 lit. a GDPR). You can withdraw your consent at any time. An informal email to me is sufficient. The legality of data processing carried out until the withdrawal remains unaffected.

5. Analysis Tools and Advertising

Matomo (formerly Piwik)

This website uses the open-source web analytics service Matomo, which employs technologies such as cookies or device fingerprinting to recognise users across different pages for behavioural analysis. Information collected by Matomo on the use of this website is stored on my server. The IP address is anonymised before storage.

Using Matomo enables me to collect and analyse data on website usage by visitors, allowing me to identify when certain pages are accessed and the region of access. I also collect various log files (e.g., IP address, referrer, browser, and operating systems) and can measure whether website visitors take specific actions (e.g., clicks, purchases).

The use of this analysis tool is based on Article 6 paragraph 1 lit. f GDPR. I have a legitimate interest in the anonymised analysis of user behaviour to optimise both my web offering and advertising. If consent was requested (e.g., consent to store cookies), processing is based solely on Article 6 paragraph 1 lit. a GDPR; consent can be withdrawn at any time.

Hosting

I exclusively host Matomo on my servers, ensuring all analytical data remains with me and is not shared.

Disable Matomo

You may choose to prevent this website from aggregating and analyzing the actions you take here. Doing so will protect your privacy, but will also prevent the owner from learning from your actions and creating a better experience for you and other users.

6. Plugins and Tools

Vimeo without Tracking (Do-Not-Track)

This website uses plugins from the video portal Vimeo, provided by Vimeo Inc., 555 West 18th Street, New York, New York 10011, USA.

When you visit one of my pages with embedded Vimeo videos, a connection to Vimeo’s servers is established, informing the Vimeo server of the pages you visited and your IP address. However, I have set up Vimeo so that it does not track your activities or set cookies.

The use of Vimeo is in the interest of an attractive presentation of my online offerings. This constitutes a legitimate interest as defined in Article 6 paragraph 1 lit. f GDPR. If consent was requested, processing is based solely on Article 6 paragraph 1 lit. a GDPR; consent may be withdrawn at any time.

Further information on how Vimeo handles user data can be found in Vimeo’s privacy policy at: https://vimeo.com/privacy.

Google Web Fonts (Local Hosting)

This site uses Google Web Fonts for uniform font display. The Google Fonts are installed locally, so no connection to Google’s servers occurs.

For more information about Google Web Fonts, please see https://developers.google.com/fonts/faq and Google’s privacy policy: https://policies.google.com/privacy?hl=en.

7. Social Media Plugins with Shariff

This website uses plugins from social media platforms (e.g., Facebook, Twitter, Instagram, Pinterest, XING, LinkedIn, Tumblr).

You can generally recognise these plugins by their respective social media logos. To protect your privacy on this website, I only use these plugins in combination with the “Shariff” solution. This application prevents the plugins integrated on this website from automatically transferring data to the respective provider when you first access the page.

Only when you activate the relevant plugin by clicking on the corresponding button will a direct connection be established with the provider’s server (consent). Once you activate the plugin, the respective provider is informed that you have visited this website with your IP address. If you are logged into your respective social media account (e.g., Facebook) at the same time, the provider can associate your visit to this website with your user account.

Activating the plugin constitutes consent within the meaning of Article 6 paragraph 1 lit. a GDPR. You may withdraw this consent at any time with future effect.

8. Audio and Video Conferencing

Data Processing

For communication with customers, I use various online conferencing tools. Details of the specific tools I use are listed below. If you communicate with me via video or audio conference over the internet, your personal data will be captured and processed by me and the respective tool provider.

The conferencing tools collect all data you provide or use to utilise the tools (email address and/or phone number). Additionally, the conferencing tools process the duration of the conference, start and end times, the number of participants, and other “contextual information” related to the communication process (metadata).

The tool provider will also process all technical data necessary for the communication to occur online. This includes, in particular, IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or speaker, and connection type.

If content is exchanged, uploaded, or otherwise provided within the tool, this content is also stored on the tool provider's servers. Such content includes, in particular, cloud recordings, chat/instant messages, voicemails, uploaded photos and videos, files, whiteboards, and other information shared during the service.

Please note that I have limited control over the data processing procedures of the tools used. The extent of data processing is determined by each provider’s privacy policy. For further information on data processing by conferencing tools, please refer to the privacy policies of the respective tools listed below.

Purpose and Legal Basis

The conferencing tools are used to communicate with prospective or existing contract partners or provide specific services to my customers (Article 6 paragraph 1 S. 1 lit. b GDPR). In addition, using the tools serves to simplify and expedite communication with me (legitimate interest as defined by Article 6 paragraph 1 lit. f GDPR). Where consent has been requested, the respective tools are used based on this consent; consent may be withdrawn at any time with future effect.

Storage Duration

The data collected by me via video and conferencing tools will be deleted from my systems as soon as you request deletion, withdraw your consent to storage, or the purpose for data storage no longer applies. Stored cookies remain on your device until you delete them. Statutory retention periods remain unaffected.

I have no control over the duration for which your data is stored by the operators of conferencing tools for their purposes. For more information on this, please refer to the privacy policies of the respective conferencing tool providers.

Conferencing Tools Used

Jitsi Meet

I use Jitsi Meet, a privacy-friendly, open-source video conferencing tool. Data is encrypted during transport over the internet, protecting it from unauthorised third-party access. No data is transferred to third parties, and the personal data of users is collected only for the duration of use. This personal data is not stored on the server.

Data processing outside the European Union (EU) generally does not occur. However, routing through internet servers outside the EU cannot be excluded, especially if participants in online conferences are in a third country.

Further details on data processing can be found in Jitsi Meet’s privacy policy: https://jitsimeet.eu/sicherheit-und-datenschutz-bei-jitsi-meet/.

Zoom

I use Zoom. The provider of this service is Zoom Communications Inc., 55 Almaden Boulevard, 6th Floor, San Jose, CA 95113, USA. For further details on data processing, please refer to Zoom’s privacy policy: https://zoom.us/de-de/privacy.html.

Data Processing Agreement

I have entered into a data processing agreement with Zoom’s provider and fully implement the strict requirements of German data protection authorities when using Zoom.

9. Social Media Presence

Data Processing by Social Networks

I maintain publicly accessible profiles on social networks. Below is a list of the social networks I use.

Social networks like Facebook, Twitter, etc., can usually comprehensively analyse your user behaviour when you visit their websites or a site with integrated social media content (e.g., Like buttons or advertisements). Visiting my social media profiles triggers numerous processing operations relevant to data protection. In detail:

If you are logged into your social media account and visit my social media profile, the operator of the social media platform can associate this visit with your user account. Your personal data may also be collected even if you are not logged in or do not have an account with the respective social media platform. This data collection is often carried out through cookies stored on your device or by recording your IP address.

The collected data enables social media platform operators to create user profiles reflecting your preferences and interests. This allows interest-based advertising to be displayed inside and outside of the respective social media presence. If you have an account with the respective social network, interest-based advertising can be displayed on all devices where you are or have been logged in.

Please note that I cannot track all processing activities on social media platforms. Depending on the provider, additional processing activities may therefore be carried out by the operators of the social media platforms. For details, please refer to the terms of use and privacy policies of the respective social media platforms.

Legal Basis

My social media appearances aim to ensure the broadest possible presence on the internet. This constitutes a legitimate interest within the meaning of Article 6 paragraph 1 lit. f GDPR. The analysis processes initiated by social networks may be based on different legal grounds, which the social network operators must indicate (e.g., consent within the meaning of Article 6 paragraph 1 lit. a GDPR).

Controller and Assertion of Rights

If you visit one of my social media profiles (e.g., Facebook), I am jointly responsible with the operator of the social media platform for the data processing operations triggered during this visit. You can assert your rights (access, correction, deletion, restriction of processing, data portability, and complaint) both against me and against the operator of the respective social media platform (e.g., Facebook).

Please note that despite joint responsibility with the social media platform operators, I have limited influence on the data processing operations of social media platforms. My options depend significantly on the corporate policy of the respective provider.

Storage Duration

The data collected directly by me via the social media presence will be deleted from my systems as soon as the purpose for storage no longer applies, you request deletion, you withdraw your consent to storage, or the purpose for data storage no longer applies. Stored cookies remain on your device until you delete them. Statutory retention periods remain unaffected.

I have no control over the duration for which your data is stored by the operators of social networks for their purposes. For details on this, please consult the privacy policies of the respective social network operators (see links below)..
